Terms of Service

These Terms of Service ("Terms") govern the web design and related services provided by H2ODreamer Studio ("we", "us", "our") to you ("the client"). By engaging us for a project — whether by WhatsApp, email, or written agreement — you agree to these Terms.

1. Services & Quotations

Every project begins with a free consultation. We then provide a quotation describing the scope, deliverables, timeline and price.
The quoted price covers the scope agreed at the time of quotation. Work added later ("scope changes") may be quoted separately.
Prices listed on our website are starting points ("from"); your final quotation may differ based on your requirements.

2. Payment

A deposit is required before work begins. The remaining balance is due before the final files are delivered or the site is published / handed over.
Deposits are non-refundable once work has commenced, as they reserve our time and cover work already performed.
Payment details and schedule are confirmed in your quotation before the project starts.

3. Revisions

Each package includes a set number of revision rounds, stated in your quotation. Additional revisions, or changes requested after a deliverable has been approved, may be charged separately.

4. Client Responsibilities

You agree to provide the content, images, logos and information we need in a timely manner.
Project timelines assume reasonably prompt feedback. Delays in providing materials or approvals will extend the delivery date accordingly.
You confirm that any materials you provide are owned by you or that you have permission to use them (see Section 7).

5. Timelines

Delivery estimates (e.g. 3–5 days for a landing page) are made in good faith and depend on project complexity and the timeliness of your feedback and materials. They are estimates, not guarantees.

6. Hosting, Domain & Third-Party Services

Hosting and domain registration are billed separately and paid directly to the relevant provider (e.g. Shopify, Hostinger). We can help you set these up, but the ongoing fees are your responsibility.
Third-party platforms and tools (such as Shopify, Google, Meta) are governed by their own terms; we are not responsible for changes to their services or pricing.

7. Intellectual Property & Content

Ownership of the final delivered website design transfers to you upon full payment.
Until full payment is received, all work remains our property.
Third-party assets (fonts, stock images, plugins) remain under their respective licences.
You warrant that all content you supply is yours or properly licensed, and you indemnify us against claims arising from materials you provide.

8. Portfolio Rights

Unless you ask us otherwise in writing, we may display the completed work in our portfolio and on our social media as an example of our services.

9. Cancellations

If you cancel a project after it has started, the deposit is retained and any work completed beyond the deposit will be invoiced. Completed and delivered work is non-refundable.

10. Maintenance & Support

Unless a maintenance package is agreed, projects are delivered as completed work. Updates, fixes or new features requested after handover are quoted as new work. Optional maintenance packages are available on request.

11. Limitation of Liability

We deliver our services with reasonable care and skill. To the extent permitted by law, our total liability for any claim arising from a project is limited to the amount you paid us for that project. We are not liable for indirect or consequential losses, including loss of profits or data.

12. Governing Law

These Terms are governed by the laws of Malaysia, and any disputes are subject to the jurisdiction of the Malaysian courts.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. The Terms in effect at the time you engage us apply to your project.
